         Evidence & Found Property

Evidence Unit Operations

The Cobb County Police Department Evidence Unit is located at 140 N. Marietta Pkwy. in the basement of the 911 Center.  The hours of operation are:

Monday - Friday 8:00 am - 5:00 pm.  The unit is closed on all holidays.

State law prohibits the returning of any found property to the finder.

Property held by the Evidence Unit is categorized in one of six ways:

Evidence

Evidence may be released prior to adjudication of the case only with authorization from the investigating officer.  Evidence may be released after adjudication upon presentation of an order from the court.  Evidence will be released only to the owner listed on the evidence report.

Hold for 90 days

Ninety day hold property may be released if, at the end of 90 days, there has not been a change in the disposition of the property.  If there has not been a change in the disposition of the property, the property will be released to the listed owner.  Ninety day hold property that is not claimed by the owner will be disposed of per court order.

Safekeeping

Property held for safekeeping may be released to the owner on, or after, the date authorized by the investigating officer.  Property held for safekeeping that is not claimed by the owner will be disposed of per court order.

Found Property

Found property may be released to the owner.  Found property is disposed of at county auction if the owner(s) cannot be located, or if the owners do not claim the property after they have been notified.

Send to Crime Lab

Property sent to the crime lab will not be released without an order from the court.

Destroy

Property marked “Destroy” will be destroyed by the Evidence Unit.

Requirements for release of property

There are legal and departmental requirements governing the return of property.  Please call ahead for specific information about the item you wish to pick up.  This will allow the Evidence Unit to process your request and will eliminate delays.  Positive photo identification (Drivers License or State Issued I.D.) will be required for release of property.

The owner of the property may designate another person to pick up the property.  This will require a signed, notarized, affidavit from the owner of the property.  The affidavit must also specify the name of the person to whom the property may be released.
